R (B) v SSHD [2008] EWHC 3189 (Admin)

Claimant awarded £32,000 in basic and £6000 in aggravated damages 6 months following a short period of lawful detention where there was evidence that claimant was a victim of torture.

Muuse v SSHD [2009] EWHC 1886 (QB); [2010] EWCA Civ 453

From the Judgement; In this appeal, the appellant (the Home Secretary) did not dispute that the respondent (Mr Muuse), a Dutch national who had been born in Somalia, had been unlawfully detained on the orders of officials pending deportation to Somalia in circumstances where there was no right to deport. However the Home Secretary challenged the decision of Mr Leighton Williams QC, sitting as a Deputy Judge of the High Court, that the unlawful detention had arisen from misfeasance in public office by officials of the Department. Whilst the Home Secretary did not dispute the award of compensatory and aggravated damages to Mr Muuse for his unlawful detention, he challenged the award of exemplary damages. Claimant awarded £32,500 in damaged for basic and £7,500 in

 

R (Johnson) v SSHD [2004] EWHC 1550

Claimant awarded £15,000 for 53 days unlawful detention at Oakington following 6 days lawful detention

 

MK (Algeria) v SSHD [2010] EWCA Civ 980

Claimant awarded £17, 500 in damages for 24 days of detention. Algerian national married to EEA national detained on basis that wife no longer exercising Treaty rights without proper enquiries being made.

 

R (Lamari) v SSHD [2013] EWHC 3130 QB

Claimant awarded £10,000 in basic, £5000 in aggravated and £10,000 in exemplary damages for 23 days following lengthy period of lawful detention. SSHD gave an undertaking to release within 14 days of hearing of JR but then, in contempt of court, failed to release for further 6 days.
