The Secretary of state's appeal was allowed against a decision of UT dismissing SSHD's appeal and the FT allowing appeal of a Tier 4 student who was refused a Tier 4 (General Student) leave to remain after the licence of his Tier 4 Sponsor was revoked by SSHD and he was given 2 months to look for a new Sponsor and make a new application.

The issue in this case was whether the appellant was entitled to the benefit of the leeway provided by the case of Patel (revocation of sponsor licence – fairness) India [2011] UKUT 00211 (IAC) in relation to students whose Tier 4 (General) sponsor ceases to run the course on which they are enrolled and whether that case was rightly decided.
